UPDATE IN TAXATION FOR THE WEEK 6THJULY TO 12TH JULY 2020

A. GOODS & SERVICES ACT

In this said week, no Notification, Circular or Order under GST Acts are issued.

B. CUSTOMS

a. NOTIFICATIONS:

i. Notification No. 29/2020- Cus dated 6th July

This Notification is amending Principal Notification 152/2009 Cus dated 31st December 2009 issued under “the India-Korea Comprehensive Economic Partnership Agreement” whereby Special Rate of Basic Customs Duties were notified when Goods imported from Republic of Korea. However due to Injury to Domestic Industries and as directed by the Directorate of Trade Remedies, the following changes/amendments have been effected as under:

The following conditions are added after these entries (230A & 230B) as under:

  • nothing contained in serial number 230A and entries relating thereto in the said Table shall have effect up to and inclusive of the 21st day of January 2021, and
  • the entries contained in serial number 230B in the said Table shall have effect up to and inclusive of the 21st day of January 2021; unless revoked, superseded or amended earlier.”.

In simple words, import of Phthalic Anhydried (any grade or quality) from Republic Korea will attract Basic Customs Duty at 7.5% from 6th July till 21st January 2021 (both days inclusive) and after 22nd January 2021 will be at NIL rate of Duty unless revoked or amended etc.

ii. Notification No. 30/2020-Cus dated 10th July 2020.

This Notification amends Principal Notification 09/2012-Cus dated 9th March 2012 (Exempting re-import of Cut and Polished Diamond (CTH 71) sent for Certification/Grading) provided re-imported within 3 months) and extends Last Date of Re-Import which fell between 1st February 2020 to 31st July 2020 by Three Months.

iii. Notification No. 17/2020 Cus (ADD) dated 8th July 2020.

This ANTI-DUMPING DUTY Notification is issued by the Customs as per the directives of the Director General of Trade Remedies on “Steel and Fibre Glass Measuring tapes and their parts and components”. The details of ADD and Origin and Exporter and ADD rate is as under:

iv. Notification No. 18/2020 Cus (ADD) dated 10th July 2020.

This Notification amends Expiry of Principal ADD Notification No. 32/2015-Cus (ADD) dated 10th July 2015 from 10th July 2020 to 9th January 2021.

The Principal Notification had imposed ADD of USD 342.76 PMT on Phenol (Bulk or Packed) imported from South Africa and other Countries.

b. CIRCULARS / INSTRUCTIONS

i. Circular 32/2020 Customs dated 06-07-2020 (F. No.: 450/78/2020-CusIV)

The circular is for establishing TURANT SUVIDHA KENDRA by the Customs Authorities at Ports (Air/Land/Sea) for Contactless Customs Procedures. Such as submission of documents (license/authorization) for defacing) (which are not uploaded on e-Sanchit); Importer/Exporter Registration, Registration of AD Code, Bank Accounts.

The Circular also clarifies that Registration of Importer Exporter as well Bank Details can also be uploaded by logging in ICEGATE. The paths are as under:

(For Importer/Exporter Registration)

i. Instruction No. 11/2020 dated 10th July 2020 (F. No.: 401/18/2020- Cus III)

In view of present pandemic of COVID-19, for importing Milk and Milk Products, “Veterinary Certificate” requirement is brought in.

ii. Instruction No. 12/2020 dated 10th July 2020 (F. No.: 401/19/2020- Cus III)

In view of present pandemic of COVID-19, for importing Blended Edible Vegetable Oils, prior AGMARK certification requirement is brought in.

C. IMPORT-EXPORT RELATED – DGFT

i. Notification No. 17/2015-2020 dated 09-06-2020.

Import of Cut Flowers and Flower Buds (CTH-ITC 0603) though is under FREE category of import but allowed to import only through Chennai Airport.

ii. Public Notice No. 12/2015-2020 dated 10th July 2020

Certain ITC (CTH) have been added in MEIS benefits with effect from 01st January 2020 and similarly, MEIS benefits have been withdrawn on certain ITC (CTH) with effect from 01st January 2020.
